On January 12, 2024, the Department of Health and Human Services (HHS), the Department of Labor (DOL), and the Department of the Treasury (collectively, the Departments) updated the No Surprises Act website to reflect upcoming changes to the Federal Independent Dispute Resolution (IDR) certified IDR entity fee ranges in accordance with the  Federal Independent Dispute Resolution (IDR) Process Administrative Fee and Certified IDR Entity Fee Ranges Final Rule (IDR Fees Final Rule), including the new fees being set by each certified IDR entity.

The IDR Fees Final Rule published in the Federal Register on December 21, 2023, became effective on January 22, 2024. The IDR Fees Final Rule sets in rulemaking the administrative fee amount and certified IDR entity fee ranges for disputes initiated on or after January 22, 2024. For these disputes, the administrative fee amount is $115 per party per dispute, and the certified IDR entity fee ranges are $200-$840 for single determinations and $268-$1,173 for batched determinations. The website now includes information on the fee set by each certified IDR entity within these ranges.

ADVOCATE will share additional information with clients and friends as it becomes available on this and other Federal Health Policies.
